1. General Terms of Use

1.1 A-Z Car Performance Kft. (Tax Number: 25118740-2-43, Registration Number: 01 09 200847), as Service Provider, is not liable for any direct or indirect material or non-material damage resulting from the use of the website and/or the failure of the service. The User accesses the website solely at his/her own risk.

1.2 The User undertakes to comply with all applicable laws, regulations and these terms of use in force at the time.

2. Products and services available for purchase

2.1 The official prices of the products and services displayed on the website can be displayed in HUF, EUR and US dollars. The VAT prices include the VAT required by law.

2.2 On the website, the Service Provider displays the name and description of the product in detail and displays photos of the products. The images displayed on the product data sheet may differ from the real ones and may be used as illustrations. The Service Provider is not liable for any differences between the image displayed on the website and the actual appearance of the product.

2.3 The Service Provider is not liable for an incorrectly indicated price despite its care and/or due to a system error, or for an obviously incorrect, unrealistic price that is significantly different from the well-known price of the product (for example, 0 HUF). In such cases, the Service Provider is not obliged to deliver the product at the incorrectly indicated price on the website. In the event of an incorrectly indicated price, the Service Provider will offer the possibility of purchasing the given product at the real price in the order confirmation or afterwards, but in any case before the delivery/delivery of the given product, with which information the User can decide whether to order the product at the real price or not.

In the event of payment of an incorrect price, the Service Provider will offer the User compensation for the real price, which is either a subsequent request for the amount between the incorrectly indicated and the real price or its refund/return. If the User does not wish to pay the difference between the incorrectly indicated and the real price subsequently, the Service Provider may withdraw from the transaction. In the event of withdrawal, the amount paid by the User will be fully refunded/returned by the Service Provider to the User, after prior, written notification.

3. Order, payment and fulfillment

3.1 Purchase process:

3.1.1. The User clicks the “Add to cart!” button on the selected product data sheet.

3.1.2. The selected product or products are added to the User’s cart.

3.1.3. By clicking on the “cart” icon in the main menu, the User will see the products added to the cart.

3.1.4. If the User does not wish to purchase any additional products, he/she clicks on the “Shipping / Pick up fee calculation” button.

3.1.5. On the page that appears, the User fills in the data required for the “Shipping / Pick up fee calculation”, and then the shipping fee is automatically displayed on the website.

3.1.6. After accepting the shipping/receipt fee, the User enters the billing and shipping data.

3.1.7. After recording the billing and shipping data, the User selects a payment option by clicking on the payment icon that suits them best.

3.1.8. If the User selects a bank card payment option, they will be taken to the SimplePay (OTP Mobil Kft.) payment terminal page, where the payment transaction will take place. If a bank transfer is selected, the User transfers the total amount to the account number found on the Order confirmation.

3.1.9. After sending the payment or billing request, the User's order will be confirmed automatically by e-mail, which will be sent to the User's e-mail address. The order confirmation email contains the following: order number, order date and time, order details, item number, name, quantity, price, shipping cost, total amount due or paid, payment method chosen, expected delivery time, message sent by the User, Service Provider details and contact details.

3.1.10 After payment, the User will receive an official Final Invoice or Advance Invoice from the Service Provider, which will be sent to the provided Email address.

3.1.11. After payment, the Service Provider will do everything possible to deliver the product or products to the User's address within the delivery date indicated for the purchased product. If the User orders multiple products, the delivery time of the product with the longest delivery time shall apply to all products.

3.1.12. If the User wishes to collect the paid product in person, the Service Provider will contact him/her within 24 hours of payment and the details of the collection will be agreed upon separately.

3.2 The Service Provider excludes liability in the event that the User's order does not arrive at the User's address because the User has provided an incorrect e-mail address or the Supplier or the Service Provider cannot contact him/her even after several attempts, i.e. the Supplier cannot package to whom to deliver.

3.3 The Service Provider is not responsible for any changes in technical descriptions or descriptions without prior notice due to reasons beyond the control of the supplier or the Service Provider. The Service Provider reserves the right to reject already confirmed orders in part or in whole. Partial fulfillment can only take place after consultation with the User!

3.4. Data transfer declaration in case of payment by bank card – SimplePay

I agree that my personal data stored in the user database of www.a-zperformance.com by A-Z Car Performance Kft. (1188 Budapest, Damjanich u. 99/A.) will be transferred to OTP Mobil Kft. (1093 Budapest Közraktár u. 30-32.), as data controller. The scope of the transferred data: last name, first name, country, telephone number, e-mail address. The purpose of the data transfer: providing customer service assistance to users, confirming transactions and fraud monitoring for the protection of users.

4. Withdrawal

4.1 The User may withdraw from the contract without giving any reason within 14 days of receipt of the ordered product, return or exchange the ordered product in accordance with applicable laws.

4.2 The 14-day right of withdrawal applies exclusively to products that are in stock at the time of the order. If the User's intention to withdraw concerns a product or products that were not in stock at the time of the order (for example, they were manufactured at the User's individual request or are purchased from an external warehouse at the User's express request), the Service Provider is not obliged to take back the product and refund the purchase price. The right of withdrawal cannot be exercised for these reasons. By accepting these Terms of Use, the User expressly acknowledges and accepts this limitation with regard to products that are not in stock at the time of the order.

4.3 The period for exercising the right of withdrawal expires after 14 days from the day on which the User took possession of the product. The User must notify the Service Provider in writing of the exercise of the right of withdrawal at info@a-zperformance.com, which the Service Provider will confirm within 48 hours. The Service Provider excludes its liability in the event that the confirmation sent within 48 hours does not arrive at the User's address because the User provided an incorrect e-mail address during registration or cannot receive messages due to the storage space belonging to his account being full. The Service Provider also excludes liability in the event that the User wishing to exercise the 14-day right of withdrawal did not receive the electronic letter because the User sent the relevant request to an incorrect E-mail address.

4.4 The User shall bear the cost of returning or returning the product and the installation costs related to the return.

4.5 In the event of exercising the right of withdrawal, the User shall not be charged any other costs than the cost of returning the product and the related installation costs, however, the Service Provider may demand compensation for material damage resulting from use, or may refuse to exercise the right of withdrawal in the case of a product whose usability and aesthetic value has decreased during the User's use.

4.6 The User does not have the right of withdrawal:

- in the case of a non-prefabricated product that was produced at the express request of the User

- in the case of a product that was clearly tailored to the User

- in the case of a product that, due to its nature, can no longer be used after installation

4.7 After taking back the product, the Service Provider shall, taking into account the above rules, refund the amount determined and mutually agreed with the User to the User within 14 days at the latest.

4.8 ​​The User is obliged to return the product within 14 days of the notification of his/her request for return within 14 days. If the product is not returned to the Service Provider's address within 14 days, the Service Provider may withdraw from its obligation to take back the product.

4.9 The User shall only be liable for any diminished value of the product if, except in the case of testing, the product has been used or if the diminished value has been caused by handling other than that necessary to establish the nature, properties and operation of the product.

4.10 The Service Provider may withhold the refund until the product has been returned or the User has provided evidence that they have been returned: whichever is earlier.

4.11 In the event of disputes, the User and the Service Provider shall first make every effort to find a mutually acceptable solution. Further steps shall only be taken if the negotiations are unsuccessful.

5. Warranty

5.1 In the event of defective performance, the Based on Government Decree 151/2003. (IX. 22.) on mandatory warranty, the company operating the website is obliged to provide a warranty.

5.2 The warranty period for all products is 1 year from the date of purchase, unless the manufacturer of the product specifies a different warranty period. The warranty period other than one year is indicated by the Service Provider on the product website for each affected product.

5.3 The warranty period is calculated from the date on which the product is in the possession of the User.

6. Applicable laws

6.1 The Service Provider complies with all laws and regulations currently in force in Hungary.

6.2 The Service Provider is the owner of all intellectual and patent rights related to the content appearing on the website available at a-zperformance.com. Consequently, the User acknowledges that the deletion of the indications indicating the existence of rights is not permitted and any partial or total reproduction without authorization constitutes an act of breach of contract. The regulations on copyright and patent rights apply in particular to: multimedia materials of any type, software, texts, articles, photographs, registered trademarks, databases and images.

6.3 The User undertakes to refrain from using the interactive services provided for the publication of messages to publish messages that are misleading, offensive, defamatory or humiliating or that are not related to the issue raised.

6.4 The User refrains from attempting to hack any automatic data processing system, or to modify or extract, in part or in whole, qualitatively or quantitatively, the databases of the website. Such acts may result in penalties.

7. Handling of personal data

This data is used and stored exclusively by the Service Provider and is not passed on to third parties without the written consent of the data owner. The data stored during registration will be modified and permanently deleted by the Service Provider at the request of the data owner. 9. Interactive Services

The User is responsible for all information, images and generally all other content published by him using the interactive services. The Service Provider is entitled to delete, in whole or in part, any content published by the User using the interactive services or sent to him using the interactive services that can be assumed to violate the provisions of the laws or regulations in force in Hungary or are contrary to accepted standards of conduct. The User acknowledges that the possible use of any content published by him is the sole responsibility of the User and that the Service Provider does not control or guarantee the accuracy, legality, quality or reliability of any content published using the interactive services provided on the website. The User is solely responsible for all contact addresses displayed using the interactive services on the website accessible at a-zperformance.com.

10. General Provisions

The Service Provider reserves the right to change the provisions of this document. By continuing to use the website available at a-zperformance.com, the User accepts such changes. This document contains the entire agreement between the parties, and no general or special conditions contained in any other document shall be considered part of the rights and obligations set forth in the agreement between the Internet users and the Service Provider. In the event that one or more provisions of this document become invalid for any reason, the remaining provisions shall remain in full force and effect. In the event that there is a contradiction between the title and content of any section, any legal action related to this fact shall be considered unfounded. The laws of Hungary shall govern the terms of this document, both in terms of form and content. The Parties concerned agree that in the event of a dispute, they will attempt to reach an out-of-court agreement before initiating any legal proceedings.
